Miri Skin Care

Miri Skin Care manufactures Miri Skin Care products. We manufacturer, pack and supply Miri Skin Care products directly from our fulfillment centre in Auckland, New Zealand.

Products and Prices

Our intention is to keep the Miri Skin Care website current. However, it is possible that information pertaining to a product or price may not be exactly as shown at the time that you place an order. Product prices are inclusive of sales tax for New Zealand only but exclusive of shipping charges.Shipping charges are shown at check out as a separate line item.

All prices are in New Zealand dollars, and postage/courier is not included in the purchase price.

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. While we endeavour to hold reasonable stocks of our product range, sometimes in the event of large orders, we may be out of stock of the item you have requested. In the event, this occurs we will advise you of delivery time.

Miri Skin Care has no control over any customs or import duties that could be charged when the package reaches your destination.

 

Subscription Service

The service or some parts of the service are available only with a paid subscription. you will be billed in advance on a recurring and periodic basis (such as daily, weekly, monthly or annually), depending on the type of subscription plan you select when purchasing the subscription.

At the end of each period, Your subscription will automatically renew under the exact same condition unless You cancel it or the company cancels it.

We reserve the right to terminate your subscription at our reasonable discretion at any time and without giving any reason for our decision.

 

Subscription Cancellations

You may cancel Your subscription renewal either through You account settings page or by contact the company. you will not receive a refund for the fees You already paid for Your current subscription period and You will be able to access the service until the end of Your current subscription period.

 

Billing

You shall provide the company with accurate and complete billing information including full name, address, post code, telephone number, and a valid payment method information.

It is your responsibility to ensure your accepted payment method details are valid and up to date. We accept Visa, MasterCard, American Express card, PayPal and afterpay.

Should automatic billing fail to occur for any reason and payment re-attempts are unsuccessful we reserve the right to recover the debt through alternative means, either directly or through a third-party.

We reserve the right to suspend or terminate future deliveries when payment are outstanding.

 

Fee Changes

The company, in its sole discretion and at any time, my modify the subscription fees. Any subscription fee change will become effective at the end of the then-current subscription period.

The company will provide You with reasonable prior notice of any change in subscription fees to give You an opportunity to terminate You subscription before such change becomes effective.

Your continued use of the service after the subscription fee change comes into effect constitutes Your agreement to pay the modified subscription fee amount.

 

Refunds

Except when required by law, paid subscription fees are non-refundable.

Certain refund requests for subscriptions may be considered by the company on a case-by-case basis and granted at the sole discretion of the company.

 

Change of Details

Change to address details and/or delivery instruction must be communicated via email Hello@miriskincare.co.nz or via our site contact page https://www.miriskincare.co.nz/contact at least 7 days prior to your next scheduled subscription.

We are not liable for any charges you incur as a result of out of date payment information. If we incur an expense due to incorrect payment information provided by you, we reserve the right to seek reimbursement from you for such expenses.

 

Placing Orders

After completing the required information fields, you submit your order, and we will acknowledge your order or indicate if it is unable to be accepted (e.g. the item is out of stock, or we cannot obtain authorisation for your payment). Our acceptance of your order and the completion of the contract between you and us will take place when we have dispatched the goods ordered by you. If you wish to cancel your order after it has been dispatched you will need to follow the Returns Policy (see Shipping).

 

Payment

Payment for purchases can be made with your Visa, MasterCard credit or debit card. If the issuer of your card does not for any reason, authorise payment to us, whether in advance or subsequent to a payment, we will not be liable for any delay or non-delivery.

Electronic payments made for products purchased from the Miri Skin Care website are highly secure. Your card details are entered into the secure portal and Miri Skin Care does not retain full card details.

 

Consumer Guarantees Act 1993 (CGA)

The CGA applies only to consumer purchases. Nothing in these Terms and Conditions is intended to be inconsistent with a consumer's rights under the CGA. If the CGA applies and if any of the goods fail to comply with any guarantee in the CGA, Miri Skin Care will repair or replace those goods. Miri Skin Care does not provide any Express Guarantees (as defined in the CGA).

 

Delivery

In accordance with the delivery option you select, we will deliver the goods to you as quickly as possible. We do not accept any responsibility for untoward delays caused by any third party, or by a delay due to any item being temporarily out of stock.

 

Acceptance of Goods

We will presume that you have inspected and accepted the goods upon receipt unless you notify us otherwise and in accordance with the procedures described in our Returns Policy. If you find that the goods received do not match the order confirmation advice, please contact us immediately at hello@miriskincare.co.nz

 

Ownership and Risk

Miri Skin Care retains legal ownership of the goods until full payment has been made by you and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you. Risk in the goods will pass to you upon delivery to you.

 

Reselling

You may not sell or resell any of the products you purchase from us unless you are an authorised Wholesaler/Agent.

 

Intellectual Property

Zest Life New Zealand Ltd is the sole and exclusive owner of the Miri Skin Care trademark, the Miri Skin Care artwork and any product or brand imagery of any description on the Miri Skin Care website. This intellectual property is protected by New Zealand, and international copyright law and no part of the trademark, artwork or imagery may be copied or reproduced without express written permission from Zest Life New Zealand Ltd.

 

Your Obligations and Responsibilities

You agree that in accessing the Miri Skin Care site that you will comply with these Terms and Conditions and that these Term and Conditions supersede any other in relation to any transaction on this website.

You guarantee that the personal information you provide to us for the purposes of purchasing product or for any other reason is true, accurate and current and you agree to accept responsibility for all activities that occur.

In the event that you wilfully or negligently damage or alter the site, you will be held liable for any and all the losses and damages that this may cause to Miri Skin Care and our affiliates.

 

Limitation of Liability

Miri Skin Care makes no representations or warranties of any kind whatsoever in connection with these terms and conditions, the site or the products except where such representations are not legally excludable. You agree that Miri Skin Care will not be responsible or liable under any circumstances, for any delays or interruptions to the site; or data non-delivery, corruption, destruction or other modification; or loss or damages of any sort incurred as a result of dealings with or the presence of off-site links on the site; or computer viruses, system failures or malfunctions which may occur in connection with your use of the site, including during hyperlink to or from third party sites; or any inaccuracies, omissions or misleading statement in the content; or events beyond our reasonable control. In any event, Miri Skin Care's maximum aggregate liability will not exceed one hundred New Zealand dollars or the value of the goods ordered whichever is greater.

 

Indemnification

You agree to indemnify and hold us harmless for any loss, damages or costs resulting from any third party claim, action, or demand resulting from your use of the Miri Skin Care website. You also agree to indemnify us for any loss, damages, or costs resulting from any action you take that causes any unreasonable disruption to our business.
